1. Purpose and Scope
Jewels of Toronto Inc. (“Jewels of Toronto,” “we,” “our”) stands behind its craftsmanship and provides this limited lifetime warranty and customer-care program to the original purchaser of jewelry sold by us. “Lifetime” means the lifetime of the original purchaser, while they own the jewelry, subject to the terms below. This is an additional voluntary service benefit, not insurance or an unconditional promise that jewelry will never require paid repairs. Mandatory rights under applicable law remain unaffected.
2. Manufacturing Defects — Covered
We will, without charge, assess and remedy confirmed defects in original materials or workmanship attributable to manufacture, including qualifying structural or stone-setting defects. Covered remedies include reasonably necessary labour and replacement materials. Where a defect is confirmed, we will select a reasonable, technically appropriate remedy such as repair, correction, or replacement of an affected component, subject to remedies required by law. Coverage begins upon delivery to the original purchaser and continues for that purchaser's lifetime while they own the jewelry, subject to this agreement. A defect is not established solely because damage or stone loss occurs after delivery.
3. Complimentary Lifetime Care
Subject to the limitations and care requirements in this agreement, routine services may include professional cleaning, reasonable polishing and scratch refinishing, inspection, adjustment or re-securing of prongs and settings, and resizing where technically feasible. Resizing of eternity bands, intricate or delicate designs, or jewelry requiring reconstruction may be impractical or may require an alternative paid solution. These benefits concern routine care and do not cover substantial reconstruction or replacement of an entire item.
4. Small Accent Stone Security
Qualifying small pavé, halo, and accent stones lost through ordinary, careful wear may be replaced without charge where the ring has been properly cared for and inspection requirements have been met. This benefit excludes loss or damage attributable to impact, snagging, excessive force, misuse, neglect, or unauthorized alteration. Center stones and other principal or large stones are not included in this voluntary small-stone guarantee. Any mandatory rights relating to an original defect remain unaffected.
5. Care and Inspection Requirements
Complimentary routine inspections are recommended approximately every six (6) to twelve (12) months. They may take place in person or by video appointment accepted by us; a virtual inspection may not reveal every issue, and physical examination may be necessary. Stop wearing jewelry if a stone becomes loose or a prong, setting, or band appears damaged. Failure to obtain inspections or continued use after a known issue may affect voluntary coverage only where it caused or materially contributed to the damage or loss. It does not automatically defeat unrelated manufacturing-defect claims or mandatory rights.
6. Accidents, Neglect and Other Exclusions
Complimentary warranty repairs do not cover damage caused by accidents, impact, excessive force, bending, crushing, snagging, chemicals, extreme heat, misuse, inadequate care, improper storage, or activities that unreasonably stress the jewelry, including heavy lifting, manual labour, exercise, and similar activities. These examples are not exhaustive; reasonable care is expected even when a particular activity is not listed. Loss or theft of the jewelry, center stone, or principal stones, and purely cosmetic deterioration beyond reasonable routine refinishing, are not covered under these voluntary benefits. Ordinary wear does not automatically constitute a manufacturing defect.
7. Individual Assessment and Fair Decision Process
We evaluate claims individually and in good faith using the item’s physical condition, photographs, workmanship, likely cause of damage, inspection and service history, and other reasonably available evidence. We may require physical inspection before determining coverage and will explain the material basis of a denial of complimentary service upon request. Our assessment does not override mandatory consumer remedies, and an exclusion applies only to the extent permitted by applicable law.
8. Repairs Outside Warranty Coverage
Although we may decline complimentary repairs for accidents, neglect, misuse, excessive force, or other non-covered causes, we aim to assist where reasonably possible. At our discretion, we may offer a paid repair or restoration, with charges reasonably associated with labour, materials, replacement stones, and necessary work. We will disclose any chargeable inspection, shipping, or diagnostic costs in advance, communicate an estimate, and obtain the client's authorization before paid work begins. Some repairs may be unsafe, impractical, or technically unfeasible due to the item's construction, condition, or material limitations. We will disclose material limitations and reasonably foreseeable repair risks identified during assessment. We are not required to provide free repairs for non-covered damage or to undertake technically unsuitable work. A voluntary discount, goodwill repair, or accommodation does not change this agreement or require equivalent treatment in other cases, except as required by law.
9. Third-Party Work
Please contact Jewels of Toronto before arranging third-party resizing, repairs, alterations, stone setting, or other work, and obtain our prior written authorization. Unauthorized third-party work may result in denial of complimentary warranty coverage for damage caused or materially contributed to by that work. We may require inspection to assess its effects. Unrelated manufacturing defects and non-excludable statutory rights remain covered; third-party work alone does not automatically void the entire warranty.
10. Submitting a Claim and Service Logistics
Contact Jewels of Toronto before shipping or presenting an item for service and provide your invoice number, description, and available photos. We may request proof of purchase and inspection records. Do not ship jewelry until we provide instructions. The client is responsible for reasonable shipping, insurance, customs, duties, and related transportation costs unless we agree otherwise in writing or applicable law requires us to bear them. We will not perform paid work without prior approval.
11. Custom Orders, Cancellation and Returns
Custom jewelry, including engagement rings and wedding bands, is generally final sale once production begins, subject to applicable law. Before production begins, a client may request cancellation of an in-person or sales-associate order; deposit treatment depends on applicable law, disclosed terms, and documented costs reasonably incurred. Completed or delivered custom orders are generally not returnable for change of mind. None of these terms limits cancellation, refund, replacement, or other remedies required by law, including for defective or misrepresented goods.
In rare, voluntary exceptions approved by Jewels of Toronto, an item must be returned in its original condition and may undergo up to fourteen (14) days of authenticity and condition verification. Once an accepted voluntary return is completed and ownership passes back to us, we may melt or otherwise dispose of the returned item. A voluntary refund may be subject to a previously disclosed fifty percent (50%) restocking fee; alternatively, at our discretion, we may offer seventy-five percent (75%) of the original ring value as store credit toward another ring of equal or greater value. These options apply only to discretionary, change-of-mind exceptions, where lawful, and never diminish a legally required remedy.
12. Eligibility, Interpretation and Legal Rights
This voluntary lifetime-care program is provided to the original purchaser and is not transferable unless agreed in writing or required by law. If a provision is unenforceable, the remainder continues to apply to the extent legally possible. A one-time accommodation or failure to enforce a term is not a general waiver. Electronic records and signatures may be used. Ontario law governs to the extent permitted by applicable conflict-of-laws and consumer-protection rules; mandatory protections in a client's province, state, or country are not displaced. No term waives non-excludable statutory warranties, rights, remedies, or protections. The full written terms should be made available before purchase.
13. Client Acknowledgment
By signing, the client acknowledges receiving and reviewing this agreement, including its coverage, care requirements, exclusions, assessment process, potential paid repairs, and custom-order terms. Signing does not constitute a waiver of mandatory consumer rights.
